I agree that it is right that the functions which the Harbour Master has hitherto discharged under Part (5) of the Hong Kong Merchant Shipping Ordinance should continue to be performed by the Harbour Master.

Under Section (6) of the Hong Kong Magistrates Ordinance, 1932, the Harbour Master, Deputy Harbour Master and the Assistant Harbour Master are each appointed Marine Magistrates and given powers to hear and determine cases of assault and battery. I agree that it is right that the Harbour Master, etc., should be relieved of these duties which seem to have no special connection with shipping. Section (6) of the Ordinance will presumably be amended.

I would, however, draw attention to Establishment Department Notice No. 53 of the 10th May, 1946. I think that in accordance with that Notice the matter be referred to J.A.P. S. before any decision is reached.
